  2. EASEMENT AGREEMENT 
  3.  
  4. OPHELIA OWNER, referred to as OWNER, and GRANT GRANTEE, referred
  5. to as GRANTEE,  agree: 
  6.  
  7. OWNER is the owner in fee simple of the following described real 
  8. estate: 
  9.

  11.  
  12. In consideration of $ 10000 ( ten thousand & no/100 dollars) paid
  13. by GRANTEE, the  OWNER grants to GRANTEE an exclusive easement to
  14. excavate and  remove sand and gravel, which shall include all
  15. necessary and  ancillary rights thereto including the right of
  16. ingress and  egress, the right to erect outbuildings or to store
  17. equipment  thereon for a period of 30 years. However, at the
  18. expiration of  the term of this lease, GRANTEE shall remove all
  19. such equipment  and outbuildings. Further, GRANTEE shall at the
  20. time of  termination of this agreement slope all banks which may
  21. be  hazardous. 
  22.  
  23. GRANTEE shall promptly begin excavation operations and shall 
  24. diligently utilize the property for the purpose of excavating 
  25. sand and gavel and shall maintain continuous and regular 
  26. excavations. 
  27.  
  28. GRANTEE shall pay $100.00 ( one hundred & no/100 dollars) per TON
  29. for all sand or  gravel removed to OWNER with settlement and
  30. payment due no later  than the fifth of each month for the
  31. previous month. GRANTEE  shall keep complete and accurate records
  32. of the amounts of sand  and gravel removed from the property. Such
  33. records shall be  subject to the right of OWNER to inspect the
  34. same at all  reasonable times. 
  35.  
  36. GRANTEE shall construct fences around any sand and gravel pits 
  37. sufficient and as used in good practice. GRANTEE shall at all 
  38. times maintain insurance with minimum limits of $SEE EXHIBIT 2 (
  39. two & no/100  dollars) for public liability.  
  40.  
  41. OWNER may use any portions of the property not being excavated or 
  42. reasonably required by GRANTEE. 
  43.  
  44. The grant of easement herein shall bind the heirs and assigns of 
  45. the OWNER; however, GRANTEE may not assign the rights hereunder 
  46. without the consent of OWNER. The rights herein shall be 
  47. specifically enforceable.
